Terms of Service

1. Acceptance of Terms

By accessing or using Dossentia (dossentia.com) you agree to be bound by these Terms of Service and our Privacy Policy. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the service.

2. The Service

Dossentia is a compliance management platform that helps organisations document high-risk AI systems under the EU AI Act (Regulation EU 2024/1689). Features include AI system inventory, risk classification, Annex IV document generation, Annex VIII registration packages, audit logging, and a compliance dashboard.

Important: Dossentia is a tool to assist with EU AI Act compliance. It does not constitute legal advice. You are responsible for reviewing all outputs and consulting qualified legal counsel for your specific situation.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify us immediately of any unauthorised use of your account at support@fhatal.com.
  • One organisation per account. Members may be added within your plan limits.
  • You must be at least 18 years old and acting in a business capacity to use the service.

4. Subscription Plans & Payment

Dossentia is offered in Starter, Pro, Business, and Enterprise plans, which differ by the number of permitted users and registered AI systems. Pricing is provided on request and confirmed in your order form or written agreement.

  • Plans and pricing are quoted individually. Contact support@fhatal.com for a quote tailored to your organisation.
  • Subscriptions are billed monthly or annually in advance.
  • All fees are exclusive of VAT. Finnish VAT applies where legally required.
  • Plan upgrades take effect immediately; downgrades take effect at the next renewal.
  • Past-due invoices may result in service suspension after 14 days' written notice.

5. Cancellation & Refunds

  • You may cancel your subscription at any time from the account settings.
  • Cancellation takes effect at the end of the current billing period.
  • We do not provide refunds for partial billing periods.
  • Upon cancellation, your data is retained for 30 days, after which it is deleted. You may export your data at any time before deletion.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of applicable law.
  • Attempt to gain unauthorised access to any part of the service or another user's account.
  • Reverse-engineer, decompile, or attempt to extract the source code of the service.
  • Use automated means (bots, scrapers) to access the service without our prior written consent.
  • Upload content that is defamatory, infringing, or contains malware.
  • Resell or sublicence the service without our prior written consent.

7. Customer Data & Intellectual Property

  • Your data is yours. You retain all rights to content you upload or create in Dossentia.
  • You grant us a limited licence to process your data solely to provide the service.
  • We do not use your data to train AI models.
  • Dossentia's software, branding, and documentation are owned by FHATAL Oy. Nothing in these terms transfers ownership to you.
  • AI-generated outputs (e.g. draft Annex IV sections) are provided as-is. You are responsible for reviewing, editing, and submitting compliance documentation.

8. Confidentiality

Each party agrees to keep the other's confidential information confidential and not to disclose it to third parties, using at least the same degree of care as it uses for its own confidential information (but no less than reasonable care). This obligation does not apply to information that is publicly known, independently developed, or required to be disclosed by law.

9. Service Availability

  • We target 99.5% monthly uptime, excluding scheduled maintenance.
  • Scheduled maintenance will be announced at least 48 hours in advance where possible.
  • We are not liable for downtime caused by third-party infrastructure providers (Hetzner, Supabase) or circumstances beyond our reasonable control.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Dossentia does not constitute legal advice. You are solely responsible for the accuracy and completeness of any compliance documentation you submit to regulators.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FHATAL Oy's total liability for any claim arising out of or relating to these terms or the service shall not exceed the fees you paid in the 12 months preceding the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility.

12. Indemnification

You agree to indemnify, defend, and hold harmless FHATAL Oy and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these terms; or (c) your infringement of any third-party rights.

13. Governing Law & Disputes

  • These terms are governed by the laws of Finland.
  • Any disputes shall first be attempted to be resolved amicably within 30 days of written notice.
  • If unresolved, disputes shall be submitted to the District Court of Helsinki as the court of first instance.
  • Nothing in this clause prevents either party from seeking emergency injunctive relief.

14. Changes to These Terms

We may update these terms at any time. For material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised terms.
